Terms and Conditions of Participation

Participation in prize draws organised by Südwest Media Network GmbH, Plieninger Str. 150, 70567 Stuttgart, hereinafter referred to as the “Organiser”, is governed by these Terms and Conditions of Participation, unless specific terms and conditions have been established for an individual prize draw. In the event of any discrepancy or conflict between these Terms and Conditions of Participation and the specific terms and conditions applicable to an individual prize draw, the latter shall prevail.

Eligibility

Only natural persons residing in Germany who have reached the age of 18 are eligible to participate. Participation in the prize draw is only possible in one’s own name. Employees of the Organiser and its affiliated companies, as well as their family members, are in no case eligible to participate.

The Organiser reserves the right, at its sole discretion, to exclude persons from participation if there are justified reasons, in particular in the event of

• manipulations or other unfair influence in connection with the implementation of the prize draw;
• false or misleading information in connection with participation in the prize draw or other violations of these terms and conditions of participation.

Exclusion from the prize draw may also occur where there are grounds for suspicion regarding the aforementioned points.

Participation

Participation in the prize draw is effected by submitting the fully completed entry form or by calling the prize draw hotline specified in the relevant prize draw. By submitting the entry form or calling the prize draw hotline, the participant accepts these Terms and Conditions of Participation.

Participation in the prize draw is free of charge, with the exception of any costs incurred by the participant for transmitting or sending the entry form or for calling the prize draw hotline, in particular postage and connection charges. These costs shall be borne by the participant.

If the entry form is submitted by post, postage charges will apply. If other means of transmission are used, such as fax or email, connection charges may apply, the amount of which may vary depending on the carrier or service provider.

Connection charges apply when participating in the prize draw by telephone. The prize draw hotline is provided by the service provider legion Telekommunikation Alchimie GmbH. Each call from a German landline costs EUR 0.50. Calls from mobile networks may be subject to higher connection charges.

Participation is only possible until the entry deadline. The entry deadline is stated in the description of the respective prize draw. The opportunity to participate ends at midnight on the date of the entry deadline. Entries, transmissions or calls received after the entry deadline will not be taken into account in the draw. Compliance with the deadline will be determined by the date and time on which the entry form is received by the organiser by post or electronically, or by the recorded date and time of the call received via the prize draw hotline.

Only one submitted entry per participant will be included in the prize draw.

The prizes to be awarded are specified in the description of the respective prize draw.

Prizes and notifications

The determination of the winners shall take place after the closing date for entries by means of a random draw among all participants. If the prize draw is linked to a task (e.g. answering a competition question), only those participants who have correctly completed the task will be entered into the draw. The organiser is responsible for determining whether the conditions for participation and winning have been met.

The winner or winners of the draw will be notified by the organiser by email or by post within four weeks of the closing date for entries. Oral notifications of prizes or prize confirmations, or notifications given in any other form, shall not be valid and shall be disregarded.
In the event of an undeliverable notification, the organiser is not obliged to make further enquiries and may determine a new winner. If the winner does not respond within one week of the prize notification, the organiser is likewise entitled to determine a new winner.

The claim to the prize may not be assigned to third parties. The prize will only be handed over to the winner. An exchange or cash payment of the prize is not possible. Non-cash prizes will be sent to the winner by post to the address provided by the winner; the organiser shall bear the shipping costs. Cash prizes will be transferred by the organiser free of charge and without fees to the bank account specified by the winner.

Any liability of the organiser for the dispatch of the prizes (e.g. dispatch of the prizes by transport companies) is excluded. The section on liability remains unaffected.

The winner is responsible for any taxation of the prize, in particular for the payment of all taxes and duties associated with the receipt and/or use of the prize.

Data protection

For participation in the prize draw, the provision of personal data is necessary.

This data will be processed for the purpose of carrying out the prize draw, sending the prizes, publishing the winners and, where applicable, for direct marketing. Processing is carried out for the performance of a contract pursuant to Article 6(1)(sentence 1)(b) GDPR. The data will be deleted once the purpose has been fulfilled, provided there are no statutory retention obligations.

In the event of a win, the winner agrees to the publication of their username, name and place of residence in the advertising media used by the organiser. This includes the announcement of the winner on the organiser’s website and its social media platforms.

Miscellaneous

The organiser reserves the right to terminate or suspend the prize draw at any time if, for technical reasons (e.g. viruses, Trojans, worms, etc., or other manipulation or errors in hardware and/or software) or for other reasons, the proper conduct of the prize draw can no longer be guaranteed. Claims by the participant for performance and/or damages in the event of early termination or interruption of the prize draw are excluded; the section on liability remains unaffected.

The organiser reserves the right to change or adjust the prize draw conditions at any time.

The organiser shall be liable only for damage caused intentionally or by gross negligence, as well as for culpable injury to life, limb and/or health.
In all other respects, any liability of the organiser is excluded to the extent permitted by law.

In particular, the organiser shall not be liable for damage arising from errors, delays or interruptions in transmission, malfunctions of technical systems and services, incorrect content, loss or deletion of data, viruses or in any other way in connection with participation in the prize draw, and, to the extent legally permissible, assumes no warranty for erroneous information or misprints in the description and promotion of the prize draw.

The foregoing provisions shall also apply to the organiser’s authorised representatives, employees and/or vicarious agents.

Unless otherwise indicated, the organiser holds all rights to the prize draw and its procedure.
